TERMS OF SERVICE

By accessing or using BeamGarage, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes through the platform or via email. Your continued use of BeamGarage after such modifications constitutes acceptance of the updated terms.

BeamGarage is a community platform that enables users to share, discover, and download vehicle configuration files for BeamNG.drive. Our services include user account management, configuration file hosting and distribution, community rating systems, and related features. We provide the platform infrastructure but do not create or endorse any user-uploaded content.

BeamGarage is an independent project and is not affiliated with, endorsed by, or officially connected to BeamNG GmbH or the BeamNG.drive game. All BeamNG-related trademarks and copyrights belong to their respective owners.

To access certain features of BeamGarage, you must create an account using Discord OAuth authentication. You are responsible for maintaining the security of your Discord account and any activities that occur through your BeamGarage account. You agree to notify us immediately of any unauthorized access or security breaches.

You may not create multiple accounts for the purpose of manipulating ratings, circumventing restrictions, or any other deceptive purpose. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

You may delete your account at any time through your Account Settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Ownership and License

You retain ownership of the vehicle configurations and associated content you upload to BeamGarage. By uploading content, you grant BeamGarage a worldwide, non-exclusive, royalty-free license to host, display, distribute, and make available your content to other users of the platform. This license exists solely for the purpose of operating and providing our services.

Content Responsibilities

You are solely responsible for the content you upload. You represent and warrant that you have all necessary rights to share the content and that it does not infringe upon the intellectual property rights of third parties. You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

Content Removal

We reserve the right to remove any content that violates these terms or that we determine, in our sole discretion, to be harmful to our users or the platform. You may delete your own content at any time through your account dashboard.

You agree to use BeamGarage in a manner consistent with all applicable laws and regulations. The following activities are strictly prohibited:

The BeamGarage platform, including its design, features, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. The BeamGarage name, logo, and associated branding elements are our property and may not be used without prior written permission.

Vehicle configurations shared on the platform are community creations. We do not claim ownership of user-generated content, but we do require the license described in Section 4 to operate our services. Users downloading configurations should respect the community spirit and credit original creators when appropriate.

We do not guarantee that user-uploaded configurations will work correctly, will not cause issues with your game installation, or will be compatible with your version of BeamNG.drive. You download and use configurations at your own risk.

To the maximum extent permitted by law, BeamGarage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, including loss of data, game corruption, or system damage.

Our total liability for any claims arising from these terms or your use of our services shall not exceed the amount you have paid, if any, for access to our services in the twelve months preceding the claim.

You may terminate your account at any time by using the account deletion feature in your Account Settings. We may suspend or terminate your account and access to our services at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to violations of these terms, fraudulent activity, or conduct that we determine to be harmful to other users or the platform.

Upon termination, your right to use the service ceases immediately. Provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

These Terms of Service shall be governed by and construed in accordance with the laws of the European Union and the applicable member state where the service operator is established, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these terms shall not be considered a waiver of that right or provision.
